A Lead-Safe Certificate issued under New Jersey’s Lead Safe Certification Law is valid for three years from the date of issuance. This is the standard validity period that applies when a property passes a lead inspection and no hazards are identified.
During that three-year period, as long as the same tenant remains in the property, your certification remains valid and you are in compliance with the law.
This is the critical point that many landlords miss. The three-year certificate validity is tied to the current tenancy. When a tenant vacates your property, the certificate becomes invalid for the next occupancy.
This means you must obtain a new Lead-Safe Certificate before a new tenant can legally move into your property, regardless of how recently your current certificate was issued. There are no exceptions to this rule.
Example 1: Your property receives a Lead-Safe Certificate in January 2025. Your tenant stays for four years. Your certificate expires in January 2028 and you need a renewal inspection at that point.
Example 2: Your property receives a Lead-Safe Certificate in January 2025. Your tenant moves out in June 2025 — just five months later. You need a new inspection before your next tenant can move in, even though your certificate is less than a year old.
